A VICTORIAN builders' warranty provider was convicted in the Melbourne Magistrates Court yesterday for providing false building warranty insurance certificates.
Dennis Murvan Gentry, of Collingwood was sentenced to a community-based order for 18 months in relation to four charges following an investigation by the Australian Securities and Investments Commission.
In June this year, Gentry pleaded guilty to two charges of issuing false Builders Warranty Insurance certificates to Como Constructions Pty Ltd in April 2004. The certificates were provided without the authorisation or knowledge of an eligible insurance provider.
Gentry also pleaded guilty to two charges of dishonestly using his position as an insurance provider to obtain funds totalling $17,100 from Tenth Zital Pty Ltd (in liquidation) and Emval Pty Ltd by providing them with unauthorised insurance certificates.
At the time, Gentry was operating as an insurance broker and represented several insurance broking businesses.
Gentry was banned from providing financial services for five years in September 2006. ASIC banned Gentry after finding that he engaged in dishonest and misleading or deceptive conduct in relation to a financial product and financial service and finding Gentry had not complied with financial services laws and that there was reason to believe he would not comply with financial services laws in the future.
