Propertyreview.com.au has become one of Australia’s most successful property news websites since it was founded in May 2003.
Propertyreview.com.au is a member of the Australian Press Council; a media partner to the Australian Property Institute and has enjoyed long term advertisers and sponsors.
Propertyreview.com.au also importantly holds the protection of a registered trademark 970499 – ‘Propertyreview.com.au’.
But some people attempt to copy successful websites and fail dismally.
One such site is ‘Australian Property Review’. It runs off a domain name www.apr.com.au, which actually stands for Applied Property Research.
We have no doubt the company running this ‘pass off’ are in breach of our protected and registered trademark; and are in contravention of the Trade Practices Act.
This was confirmed when IP Australia denied them registration for their ‘pass off’ (See IP Australia adverse Report attached).
So for our readers, we post this story as a warning and to assist our readers in the confusion created by the ‘pass off’.
Below is the Adverse Report from IP Australia to further warn our readers of the true circumstances of this long running matter. We also have a Federal Court Undertaking from the previous owner.
In the meantime, we await further legal advice (potentially from our readers many major law firms) and hope common sense will eventually prevail.
